New York Alcohol Sampling and Tasting Laws
Last checked: November 6, 2026 (ABC Law 63-a read). The SLA advisory page blocked our automated check that day; last read October 17, 2026.
This is not legal advice. It is a plain-English summary of public law. Rules change and local governments often add their own. Verify with the state agency linked below before you plan a tasting.
- Tastings must be "conducted by the licensee or an authorized agent of the licensee," and the licensee or its agent stays on the premises for the whole tasting.
- No sample may exceed one-quarter fluid ounce, and no more than three samples per person per calendar day.
- Manufacturers and wholesalers licensed under sections 61 and 62 may hold tastings at off-premises retail stores; retail licensees may hold them on their own premises.
- Separately, the SLA's supplier and wholesaler Marketing Permit (ABC Law 99-b(1)(k), SLA Advisory 2022-16) covers marketing events where the permit holder or its authorized agent conducts the event.
Verify
who the "licensee" is for your event, and whether a Marketing Permit is needed.
